Thursday, the United States Senate unanimously passed legislation to create a billion dollar fund which will help small telecom providers remove and replace Huawei and ZTE network equipment.

Besides that the bill also prohibits telecom operators from using funds of the Federal Communications Commission to buy Huawei or ZTE equipment.

The new law, called the "Secure and Trusted Communications Networks Act" The "Secure and Reliable Communications Networks Act" was approved by acclamation in the House in December.

It does not mention the name of Huawei or ZTE, but stipulates that the FCC must produce a list of equipment suppliers "posing national security risks" and prohibits Internet service providers and telephone companies from using FCC funds to buy, rent, lease or maintain the equipment and services of these companies.

The FCC had already taken action against one of the companies last November, when it identified Huawei as a threat to national security and prohibited telecommunications groups from using FCC funds to purchase equipment.

In December, Huawei sued the FCC to try to end the ban, but a judge of the United States District Court ruled in favor of the FCC.

The "permanently remove" and "replace" support fund for Huawei or ZTE equipment from all networks can be used to purchase, rent or lease replacement equipment and services.

The bill tries to prevent the misuse of funds by requiring ISPs to provide "detailed accounting" of how they spend funds. Democratic and Republican members of the House Commerce Committee welcomed the Senate's work, stating:

"In today's interconnected world, the future of wireless technology in the United States depends on building networks that are free from malicious foreign interference," they said in a joint statement Thursday. 

The existence of Huawei technology on our networks represents a major threat to the national and economic security of the United States.

To help ISPs to find replacement technologies, The bill instructs the FCC to "develop a list of suggestions to replace physical and virtual communications equipment, applications and management software. The list must be "technologically neutral".

The FCC also opened an online portal for ISPs receiving FCC funds. to submit information about your use of Huawei and ZTE equipment and services. The purpose of the data collection is to determine the number of Huawei and ZTE equipment on the FCC-funded networks and the costs associated with the removal and replacement of such equipment.

The bill also requires the Federal Commission to "immediately notify" Congress if it determines that $ 1 billion will not be sufficient "to fully fund all approved claims," ​​with which Congress will likely consider increasing the fund.
